Trakki Terms of Service

These terms are a contract between you and Silksome LLC, a limited liability company registered in the State of Wyoming, United States (filing number 2026-001987179), of 30 N Gould St Ste N, Sheridan, WY 82801, United States ("Silksome", "we", "us"). They cover the Trakki app and the Trakki pages of silksome.com (together, "Trakki").
What we do with your data is explained in our Privacy Policy. If you live in Washington or Nevada, also see our Consumer Health Data Privacy Policy.
By creating a Trakki account or using Trakki, you agree to these terms. If you don't agree, don't use Trakki.

This summary is here to help. It doesn't replace the full terms below.
- Trakki estimates. It doesn't measure, and it isn't medical advice. The allergen filter is not a safety feature. See section 8.
- Subscriptions renew automatically until you cancel them in the App Store or Google Play. See section 4.
- Refunds are handled by Apple or Google, not by us. See section 5.
- Your data is yours. You can delete your account and everything in it at any time. See section 13.
#1. Who can use Trakki
You must be at least 16 years old to use Trakki. Trakki is a calorie and body-weight tracker, and we don't think that's appropriate for children.
You must also be legally able to enter into a contract where you live. You can't use Trakki if the laws that apply to you don't allow it.
#2. Your account
You need an account to use Trakki. Your log has to be stored somewhere, and an account lets it follow you to a new device.
- One account per person. Don't share your account, and don't create accounts for other people.
- Use an email address you can check. It's the only way we can reach you, and the only way to get back in if you lose access.
- Keep your account secure. You're responsible for what happens under your account. If you think someone else has got into it, change your password and email us at support@silksome.com.
You can delete your account at any time. See section 13.
#3. What Trakki costs
Trakki is a paid subscription app. There's no free version and no version with ads. The app costs real money to run, and we'd rather charge you for it than sell anything about you.

The price shown in the app is the one you pay. It comes directly from the App Store or Google Play, in your currency, with any tax that applies where you live. The table above shows United States prices as an example. If it's ever different from the price in the app, the app is correct.
#4. Subscriptions, trials and cancellation
Please read this section carefully. It describes a recurring charge.
#Automatic renewal
Your subscription is sold and billed by the App Store or Google Play, depending on where you bought it. They take your payment, and we never see your card details.
Subscriptions renew automatically. At the end of each period, your store charges you for the next one, at the price that applies at that point. It keeps doing this until you cancel.
#The free trial
Both plans start with a 7-day free trial, available once per person. Unless you cancel at least 24 hours before the trial ends, it becomes a paid subscription and you're charged. This is how both stores run trials, and we can't change it.
Your store decides whether you can have a trial. For example, Apple allows one introductory offer per Apple ID for each group of subscriptions. So if you've already had a free trial on one Trakki plan, you won't be offered one on the other.
#Switching plans
You can switch between the monthly and annual plans in your store's subscription settings. Your store decides when the switch takes effect and how the change is charged or credited, and it shows you this before you confirm.
#If a payment fails
If a renewal payment doesn't go through, your store may try again for a while, and may let you keep using Trakki in the meantime. If the payment still fails, your subscription ends.
#How to cancel
You cancel in your store account, not in Trakki. Neither store lets an app cancel a subscription for you.
- iPhone or iPad: Settings → your name → Subscriptions → Trakki → Cancel Subscription.
- Android: Google Play Store → your profile picture → Payments & subscriptions → Subscriptions → Trakki → Cancel subscription.
When your store gives us a link to your subscription settings, you can also get there from Settings → Subscription in Trakki.
Cancel at least 24 hours before your current period ends, or you'll be charged for the next one. Cancelling stops future charges. It doesn't end the period you've already paid for, and you can keep using Trakki until it runs out.
Deleting your Trakki account doesn't cancel your subscription. The subscription is part of your Apple or Google account. Cancel it there first, then delete your Trakki account.
#Price changes
We may change our prices. A price change never affects a period you've already paid for, and your store tells you before a higher price applies.
Depending on your store, how big the increase is and where you live, you may be asked to agree to the new price. If you don't agree, your subscription won't renew. Either way, you can cancel before the new price starts.
#5. Refunds
Apple and Google handle all Trakki refunds, under their own policies. We don't process your payment, so we can't give, cancel or promise a refund ourselves.
- Cancelling doesn't refund the current period. You keep access until the end of it instead. We don't offer partial or pro-rated refunds for time you haven't used, unless your store's policy or the law requires it.
- To ask for a refund:

- Google Play: play.google.com/store/account/orderhistory, then Report a problem
- In the EU and UK, Apple's own terms let you cancel an App Store purchase within 14 days of getting your receipt, without giving a reason. Ask Apple using the link above. For Google Play purchases, Google's terms and refund policy apply.
- If a payment is refunded or reversed, either by the store or through a chargeback, the subscription it paid for ends. You then lose access to Trakki.
- If you think you were charged by mistake, email support@silksome.com anyway. We'll help you make your case to the store, and if the mistake was ours, we'll say so.
Nothing in these terms limits any refund right you have by law. This includes the right to cancel under EU or UK consumer law and the consumer guarantees under the Australian Consumer Law.
#6. Your content
Everything you put into Trakki is yours. This includes your food log, photos, weights and messages to the coach.
You give us permission to do only what we need to run Trakki for you:
- store your content;
- show it back to you;
- send the relevant parts of it to the AI providers named in our Privacy Policy, so they can return the estimate, answer or plan you asked for.
This permission ends when you delete your content or your account. The only exception is the short-term copies described in the Privacy Policy.
We don't use your content to train AI models, and our AI providers don't either.
You're responsible for what you upload. Only upload photos and information you have the right to share. Don't upload photos of other people unless they've agreed.
#7. AI features
Trakki uses AI models to identify food, estimate nutrition, answer your messages to the coach and write meal plans. The coach is an AI, not a person, and the app labels it as an AI.
AI answers are created automatically. They can be wrong, incomplete or inconsistent, and they can sound confident even when they're wrong. You might get a different answer if you ask again, and other people may get different answers to the same question.
You can use what Trakki creates for your own personal purposes. Check anything important before you rely on it. Never rely on it for anything covered in section 8.
#8. Trakki estimates. It doesn't measure, and it isn't medical advice.
This is the most important section of these terms.
#Every number is an estimate
Trakki uses an AI model to identify food from photos and text and to estimate its calories and nutrients. These estimates are often wrong, and sometimes very wrong. A photo can't show portion size, hidden fats, how the food was cooked or differences between brands. Figures for branded products come from public databases that we don't control and can't check.
Treat every number in the app as an approximation.
#Your targets are an average, not a measurement
Your calorie and macronutrient targets come from a standard equation (Mifflin-St Jeor), using the figures you entered. The equation describes an average person, not your own metabolism.
#Trakki isn't medical advice
Trakki is a general wellness product, not a medical device. Nothing in it is medical, nutritional or dietary advice.
- Trakki doesn't diagnose, treat, cure or prevent any medical condition.
- The coach isn't a doctor, dietitian or other health professional, and it can be confidently wrong.
#Don't rely on the allergen filter
The allergen and exclusion filter is not a safety feature. If you have a food allergy, never rely on it.
- It checks words against a list of ingredient names that we wrote ourselves. It's a best effort, not a guarantee.
- It doesn't know what's actually in a dish, and it has never seen the food. If an ingredient isn't on its list, it won't catch it.
- It only checks the meal plans Trakki writes for you. Food you photograph, type in or scan by barcode isn't checked against your exclusions at all.
Always read the actual ingredients on the actual product.
#Talk to a doctor or dietitian
Talk to a doctor or registered dietitian before making big changes to your diet. This matters most if you:
- are pregnant or breastfeeding;
- are under 18;
- have diabetes or another medical condition;
- take medication that's affected by what you eat;
- have ever had disordered eating.
If food, weight or your body is something you struggle with, Trakki may not be good for you. Stop using it, and talk to someone you trust or a professional.
#Emergencies
Trakki isn't for emergencies, and the coach can't help in a crisis. If you're having a medical emergency, or you're thinking about harming yourself, contact your local emergency services or a crisis line now. In the United States, you can call or text 988.
#9. What you agree not to do
Don't:
- use Trakki to break the law, or upload anything illegal, including any sexual content involving a minor;
- upload other people's photos or personal information without their permission;
- attack, overload, probe or disrupt Trakki or the systems it runs on;
- access Trakki using bots, scrapers or other automated tools;
- copy, modify or reverse engineer the app, except where the law allows you to;
- try to get around the usage limits, or use paid features without a subscription;
- share, sell or rent out access to your account;
- lie about your age or who you are.
#10. Our app and intellectual property
Silksome LLC owns Trakki. That includes the app, its design, text and graphics, and the Trakki name and logo.
We give you a licence to use Trakki for your own personal, non-commercial purposes. The licence is non-exclusive, non-transferable and can be withdrawn. You must follow these terms and your app store's rules to use it. We keep all other rights.
Feedback. If you send us ideas or suggestions, we can use them freely, and we won't owe you anything for them.
Other people's data and software:
- Barcode data. Product information from barcode scans comes from Open Food Facts. It's © Open Food Facts contributors and available under the Open Database License.
- Open-source software. Trakki includes open-source software, which is licensed to you under each component's own licence.
#11. Availability, limits and changes
We aim to keep Trakki running, but we can't promise it will always be available or free of errors. It also relies on other companies' services, which we don't control.
Usage limits. Photo scans, coach messages and meal plans each cost us money, so each one has usage limits:
- photo scans and coach messages have a daily limit, a larger limit over a rolling 30 days, and a short-term limit that stops a faulty app from using up your whole allowance in a few minutes;
- meal plans have a weekly limit on the number of dishes Trakki writes for you.
The limits are set well above normal use. We may change them.
Changes to Trakki. We may change or remove features. If we remove something you rely on, we'll let you know in good time first.
If we ever close Trakki, we'll:
- give you at least 30 days' notice;
- do what the app stores allow to stop subscriptions from renewing;
- ask Apple or Google to refund any time you've paid for but can no longer use;
- give you a way to get a copy of your data before it's deleted.
#12. Apple and Google
You also agree to the terms of the store you downloaded Trakki from. You also agree to any other third-party terms that apply when you use Trakki, such as your mobile provider's.
#If you downloaded Trakki from Google Play
Google isn't part of this agreement and isn't responsible for Trakki.
#If you downloaded Trakki from the App Store
The following terms also apply:
- This agreement is with us, not Apple. These terms are between you and Silksome. Apple isn't responsible for Trakki or its content.
- Licence. We give you a licence to use Trakki on any Apple device you own or control, as allowed by the Usage Rules in Apple's App Store Terms of Service. You can't transfer this licence. If Apple's Family Sharing is available for Trakki, other accounts in the purchaser's family group can use it too.
- Support. Only we are responsible for supporting and maintaining Trakki. Apple doesn't have to provide either. For help, email support@silksome.com.
- Warranty. If Trakki doesn't meet a warranty that applies to it, you can tell Apple, and Apple will refund what you paid for Trakki. As far as the law allows, Apple has no other warranty responsibility for Trakki.
- Claims. We're responsible for dealing with any claim about Trakki, not
Apple. This includes:
- claims that Trakki caused harm;
- claims that Trakki doesn't meet a legal or regulatory requirement;
- claims under consumer protection or privacy laws;
- claims that Trakki infringes someone else's intellectual property. For these, we're responsible for investigating, defending, settling and resolving the claim.
- Legal compliance. You confirm that:
- you're not in a country that's under a United States government embargo, or that the United States government has designated as supporting terrorism;
- you're not on any United States government list of prohibited or restricted parties.
- Apple can enforce these terms. Apple and its subsidiaries are third-party beneficiaries of these terms. This means they can enforce these terms against you.
#13. Ending your account
#If you want to leave
You can delete your account at any time in Settings → Account → Delete my account. Your data is deleted permanently and immediately, as the Privacy Policy explains. If you no longer have the app, see how to delete your account without the app.
Cancel your subscription first. Deleting your account doesn't stop the billing.
#If we end your access
We may suspend or close your account if:
- you break these terms;
- the law requires us to;
- we need to, to protect Trakki or other people.
Where it's reasonable, we'll tell you why and give you a chance to fix the problem first.
If we close your account without good reason, you're owed a refund for the time you've paid for but haven't used. We can't pay this to you directly, because your payment went to Apple or Google and only they can refund it. We'll ask them to refund you and support your request.
#What still applies afterwards
Sections 5, 8, 10, 14, 15, 16, 18 and 19 still apply after your account ends.
#14. Disclaimers
Trakki is provided "as is" and "as available". As far as the law allows, we make no promises about it beyond those in these terms. In particular, we don't promise that it's accurate, complete or suitable for any particular purpose.
#15. Limitation of liability
As far as the law allows, we're not responsible for:
- indirect, incidental, special or consequential losses;
- lost profits or lost data;
- any decision you make based on an estimate, answer or plan from Trakki.
Where the law doesn't let us exclude our responsibility, the most we'll pay you in total is either US$100 or the amount you paid for Trakki in the 12 months before your claim, whichever is greater.
Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow us to limit.
#16. Indemnity
If you break these terms or the law while using Trakki, and someone makes a claim against us because of it, you agree to pay the reasonable losses and costs we have because of that claim.
This section only applies as far as the law allows. It doesn't apply to you if you're a consumer in the EU, the EEA or the UK.
#17. Changes to these terms
We may update these terms. If we make a significant change, we'll tell you by email or in the app at least 14 days before it takes effect. Changes we need to make to follow the law or to fix a security or safety problem may take effect sooner.
The date at the top of this page always shows when these terms were last updated.
If you keep using Trakki after a change takes effect, you accept the new terms. If you don't accept them, cancel your subscription and delete your account.
#18. Governing law and disputes
These terms are governed by the laws of the State of Wyoming, United States. Wyoming's rules on which country's or state's law applies don't override this. Disputes can be heard by the state and federal courts in Wyoming, but claims can also be brought in other courts. Either of us can also take a claim to a small claims court if it qualifies.
If you're a consumer, you still have the protection of the mandatory laws of the country where you live, and you can bring a claim in your local courts.
Before starting a dispute, please email support@silksome.com. Most problems are misunderstandings, and we'd rather fix them than argue about them.
#19. General
- Entire agreement. These terms, together with the policies they mention, are the whole agreement between you and us about Trakki.
- Invalid parts. If any part of these terms can't be enforced, the rest still applies.
- Enforcing later. If we don't enforce a term straight away, we can still enforce it later.
- Transfers. You can't transfer your rights under these terms to anyone else. We can transfer ours if our business is merged, bought or sold, and we'll tell you if this happens. The Privacy Policy explains what happens to your data if it does.
- Events beyond our control. We're not responsible for problems caused by things we can't reasonably control.
- Notices. You agree that we can send you notices about your account and these terms by email or show them in the app.
- Language. If these terms are translated, the English version is the one that applies.
